"Vivian Artstyle," "we," "us," and "our" refer to the operator of this store, based in Germany (EU). "You" and "Customer" refer to any user of the Website or purchaser of our products.

By accessing the Website or placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and any other policies referenced on the Website.

We reserve the right to update these Terms at any time. The version published on the Website at the time of your order applies to that order.

Orders & Fulfillment

All products sold on the Website are print-on-demand items produced and fulfilled by our third-party fulfillment partner, Printful, after an order is placed.

Order placement does not constitute final acceptance of your order. We reserve the right to accept, decline, or cancel any order at our discretion, including for suspected fraud, pricing errors, stock or production limitations, or legal compliance reasons.

You are responsible for providing complete and accurate order information, including shipping address, contact details, and product selections (including size and variant). We are not responsible for delays, losses, or additional costs resulting from incorrect information submitted by you.

Because products are made to order, production begins shortly after purchase and orders cannot be modified or canceled once processing has started.

Pricing & Payment

Product prices are displayed in EUR and or USD, depending on your selected currency or location settings. Final charged amounts may vary due to exchange rates, payment provider fees, and your card issuer's policies.

All prices, taxes, and charges shown at checkout are those applicable at the time of purchase. We reserve the right to change prices at any time before order confirmation.

Payments must be made using approved payment methods shown at checkout. By submitting payment information, you represent and warrant that you are authorized to use the selected payment method.

In the event of an obvious pricing or typographical error, we reserve the right to cancel affected orders and issue a full refund of amounts paid.

Shipping & Customs

We ship worldwide. Shipping times shown on the Website are estimates only and are not guaranteed delivery dates.

Estimated timelines include production time by Printful, transit time by shipping carriers, and possible customs clearance delays for international shipments.

Risk of loss and title transfer to you upon delivery to the shipping address provided at checkout, to the extent permitted by applicable law.

For shipments outside the country of fulfillment, import duties, customs fees, brokerage charges, and local taxes may apply. These charges are solely your responsibility as the buyer and recipient. We do not collect or control such charges unless expressly stated at checkout.

If a shipment is refused, unclaimed, or returned due to unpaid customs or import charges or incorrect address details, we may deduct shipping, return, and handling costs from any eligible refund.

Returns & Refunds

Due to the made-to-order nature of our products, we only accept claims for items that are defective, misprinted, or damaged in transit.

We do not accept returns, exchanges, or refunds for change of mind, incorrect size selection by the customer, buyer's remorse, or minor variations in color or placement that are commercially acceptable and consistent with print-on-demand processes.

If your item is defective, misprinted, or damaged, you must contact us at vivian@vivianartstyle.online/ within 14 days of delivery, including your order number, a description of the issue, and clear photographic evidence.

If approved, we may, at our discretion, provide a replacement, store credit, or refund to the original payment method.

If you are an EU or EEA consumer, you may generally have a statutory 14-day right of withdrawal for distance contracts. However, under applicable EU consumer law, this right is typically excluded for goods made to the consumer's specifications or clearly personalized. Our print-on-demand items are custom produced per order and are generally non-withdrawable except where required by mandatory law. Nothing in these Terms limits any non-waivable statutory rights.

Intellectual Property

All content on the Website, including artwork, designs, images, graphics, logos, text, branding, layout, and software, is owned by or licensed to Vivian Artstyle and protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, sell, or exploit any Website content without our prior written consent, except as permitted by mandatory law.

Any unauthorized use of our intellectual property may result in legal action.

User Obligations

You agree to use the Website lawfully and in good faith. You must not use the Website for fraudulent, unlawful, or abusive purposes, interfere with Website security, functionality, or performance, upload or transmit malware or harmful content, infringe intellectual property or privacy rights of others, or submit false, misleading, or unauthorized payment or order information.

You are responsible for maintaining the confidentiality of your account credentials (if applicable) and for all activities under your account.

Limitation of Liability

To the maximum extent permitted by applicable law, Vivian Artstyle shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, goodwill, or business interruption, arising from or related to your use of the Website or purchase of products.

Our total aggregate liability for any claim arising out of or relating to an order shall not exceed the amount paid by you for that specific order.

Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law, including liability for intent, gross negligence, fraudulent misrepresentation, or death or personal injury caused by negligence where such exclusion is prohibited.

You agree to indemnify, defend, and hold harmless Vivian Artstyle, its affiliates, officers, and service providers (including fulfillment partners), from and against claims, liabilities, damages, losses, and expenses arising from your breach of these Terms, misuse of the Website, or violation of applicable law or third-party rights.

Governing Law

These Terms are governed by the laws of Germany, excluding conflict-of-law rules and, where applicable, the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer resident in the EU, UK, US, Canada, or another jurisdiction, you may also benefit from mandatory consumer protections of your country of residence, which remain unaffected.

For disputes not resolved amicably, the competent courts at our registered place of business in Germany shall have jurisdiction, unless mandatory consumer law provides otherwise.
